U.S. Representative Nathaniel Moran (TX-01) has introduced bipartisan legislation that would give copyright holders the right to know if their work was used to train AI models.

Why it matters: The Transparency in AI Training (TRAIN) Act addresses a growing concern among Texas creators and small businesses: AI companies using copyrighted material without authorization or compensation, with no legal requirement to disclose their training data sources.

Need-to-know:

  • The bill would allow copyright owners to request administrative subpoenas to obtain information about AI training practices when they suspect unauthorized use

  • Currently, few AI companies voluntarily disclose their training data, and existing law does not require them to do so

  • The legislation has support from major creative industry organizations, including the Recording Industry Association of America, SAG-AFTRA, and the Nashville Songwriters Association International

  • The bill creates a transparency mechanism without changing existing copyright law or imposing new federal mandates

  • Co-sponsored by Representative Madeleine Dean (PA-04), the legislation aims to level the playing field for creators and small businesses
